Your Estate

ESTATE PLANNING

Estate planning helps ensure your assets pass to the people you choose and that the right decision makers are appointed to act on your behalf. It is more than simply preparing a will. We consider your assets and investments in a holistic way and can advise on strategies to protect them if a beneficiary faces legal issues such as bankruptcy or a disability. Proper estate planning can ease the burden on your family and minimise the risk of potential claims being made against your estate.

WILLS

A Will ensures your assets are gifted to the beneficiaries or charities you choose. If you do not have a Will, the Intestacy Act will determine who receives your assets and in what shares. Your willable estate generally includes assets such as real property, bank accounts and shares. In most cases, superannuation does not form part of your estate, so it is important to obtain advice about the difference between a binding and a non-binding death benefit nomination.

ENDURING POWER OF ATTORNEY

Enduring Power of Attorney arrangements operate during your lifetime to ensure your financial affairs can be managed if you are unable to do so yourself. An Attorney is the person you appoint to make financial decisions on your behalf if you become incapacitated—for example due to a stroke, dementia, or other illness or injury. This can include dealing with your banking, paying expenses, managing property and investments, and attending to day-to-day financial matters. Appointing an Attorney in advance can reduce stress for your family and help ensure decisions are made efficiently and in accordance with your wishes.

ENDURING GUARDIANS

If you want certainty about who can make decisions regarding your health, medical treatment, aged care and/or end of life matters, you should appoint an Enduring Guardian. If you do not appoint an Attorney or a Guardian while you have capacity, the Guardianship & Administration Board may instead appoint an administrator, such as the Public Trustee, rather than a family member.

ELDER LAW

Our friendly staff can assist with a wide range of services, including retirement village and aged care agreements, estate planning, granny flat agreements and advanced care directives. We can guide you through each step, explain your options in plain language and help ensure the documents properly reflect your wishes. We also provide advice and support in relation to elder abuse, including identifying concerns early and taking practical steps to protect you or a loved one.

ESTATE ADMINISTRATION

We can assist you with the process of dealing with a deceased person’s assets. Estate administration can be complex, particularly where the Executor is required to apply for and obtain a Grant of Probate. If a person dies without a will, they are said to have died “intestate”, and the next of kin may need to obtain “Letters of Administration”. Our experienced staff can assist and guide you through each step of the process.
